Terms & Conditions
By accepting the proposal, you are agreeing to the terms and conditions set out below.
1. After acceptance of the quotation, a deposit of 70% of the agreed fee shall be paid to Beyond Design Australia Pty Ltd (Hereafter BDA) to secure the booking. The remaining 30% of fee is required five business day prior to installation for goods to be released from our warehouse. In the event that payment is to be made by way of EFT a remittance is required 5 days prior to secure the date of installation.
2. The hire period commences on the day the furniture is installed and will continue for a minimum hire period of 28 days. Furniture can be removed prior to 28 days at the Client’s written request, however the fee for the minimum hire period will remain. No refund is available if the property sells and / or the furniture is removed prior to the end of the hire period.
3. BDA reserves the right to remove the furniture after the paid hire period should the property be sold. Any free hire period is for the purpose of the sales campaign only.
4. If for any reason BDA is unable to gain access to the delivery address on the agreed installation date or agreed removal date, you must also pay all additional costs incurred by us for the re-delivery or re-pickup of the goods.
5. The Client grants BDA permission to enter and remain on the property to install or remove the furniture and accessories used by BDA. The Client shall ensure that the Property is accessible to BDA for the duration of the Services.
6. BDA will provide estimated times for installation. Arrival and completion times can vary depending on logistics, traffic and access. We recommend that photography is booked no sooner than the next business day and should not be booked on the same day as installation.
7. Extensions are available with 14 days written notice from the expiry of the original hire period. Extensions will be charged at the weekly hire rate. Should an extension be requested inside 14 days notice, BDA may be unable to accommodate the request as the furniture may be committed to another property. Extensions are available for a minimum of 14 days and payment is required in full 48 hours prior to the expiry of the original hire period.
8. The Client agrees not to remove or allow any other person to remove the Goods from the premises. All items remain the property of BDA. The Client shall have no claim as to the ownership of such Furniture and Accessories. The Client must take all reasonable steps to protect the goods from any loss or damage.
9. All Furniture and accessories are insured against flood, and fire.
10. All Items are intended for display purposes and must not be used in any way by The Client. If any items are stolen, damaged, soiled or marked while the items are in The Clients property, the Client agrees to compensate BDA for the full retail expense of repairing, cleaning or replacing items.
11. BDA may install all wall hangings. This may involve drilling and the use of appropriate wall anchors. Wall anchors will remain in the walls after the job has been removed and BDA will not be responsible for painting and patching holes.
12. Cancellation must be provided in writing from the Client. Cancellation within 5 business days of the agreed installation date will incur a fee that includes one week’s hire, and a $330 administration fee.
13. Where requested by the client, BDA can assist with coordinating the removal of the Clients furniture from the property. Please be advised, we accept no responsibility for the loss or damage of such items. A separate contract and fee will be provided for this service by a third party.
14. BDA will use all reasonable endeavors to present the Property in the best possible manner to potential buyers, but cannot guarantee the Property will sell faster or at the highest market value and is not responsible for the final outcome of any sale of the Property.
15. The Client should ensure that BDA’s advice is satisfactory from a health and safety perspective of those who will access the Property. BDA does not accept liability for any loss, injury, cost or inconvenience sustained by any person using any information provided by BDA or accessing the Property during the term of this Agreement and the Client releases and indemnifies BDA in respect to the same.
16. Whilst BDA uses due care in providing its Services, the Client releases and indemnifies BDA in respect to any loss, damage, liability, cost or demand which may arise in respect to any of the following:
a) that the Property may be damaged by weather including by sun or water damage. BDA recommend that appropriated window treatments are installed and used so as to prevent sun damage to the Property and the Furniture and Accessories installed by BDA; and
b) that certain items of furniture and accessories used by BDA in the furnishing and staging of the Property will be heavy and may leave impressions, compressions, scuffs or marks on floors or walls. Whilst BDA will use all reasonable endeavours to limit the same, the Client acknowledges that some impressions, compressions, scuffs and marks are unavoidable; and
c) that damage caused to the Property during open homes or during inspections by potential purchasers.
d) BDA recommends careful supervision of all people who access the Property.
17. The Client gives permission for the use in BDA’s portfolio any professional photography of the Property.
18. Any dispute or difference between the Client and BDA may be notified by a party to the other party and the the parties shall firstly meet to negotiate, in good faith, resolution of the dispute and secondly, if negotiation fails to achieve a resolution of the dispute within five (5) working days of the notification of the dispute, attend mediation, administered in accordance with procedures as set out by the Institute of Arbitrators and Mediators Australia, provided that this provision shall not prevent BDA from instituting legal action at any time to recover moneys owing by the Client to BDA.
19. In the case that the property will be partially styled, that is BDA product will be added to complement pieces of the Clients existing furniture, the Client will ensure:
a. The house and existing furniture is clean and ready for styling
b. The Client will not be at the property at the time of installation in order to ensure a timely installation.
20. BDA reserve the right to style the property in order for to be best represented. This may vary from the original suggested product list and or images provided as part of the proposal.
• By signing this proposal, I hereby acknowledge and accept the terms and conditions set out in this agreement.
• I authorize BDA to charge my credit card provided for the amount due and for any agreed extensions for as
long as the hire furniture remains in my property
OR
I will deposit the amount due by way of EFT a minimum of 5 days prior to the installation date. I will make
additional payments for any agreed extensions a minimum of 24 hours prior to the extension period.
